General Conditions of the Service

1. SERVICE CONTENT

Scacco Malto S.r.l. (registered office at Via della Verdura 9/11, 64100 Teramo (TE)) provides users (hereinafter referred to as 'Users') who wish to make use of it, a web-based service (hereinafter referred to as the 'Service') allowing the consultation of information about Italian craft beers (hereinafter referred to as 'Products'). The Service also allows Users to purchase the Products (e-commerce) and post reviews in written or audio form

2. OWNERSHIP OF THE PLATFORM

Scacco Malto S.r.l. is the sole owner of the web platform www.scaccomalto.online, .eu, .store, .net, through which the Service is managed, including all related rights inherent to and resulting from the exploitation of the same platform.

3. APPLICABILITY OF THE TERMS

These General Terms of Service apply to Users utilizing the consultation and purchase Service of Products published by Scacco Malto S.r.l..

4. TERMS OF SERVICE

According to the Italian legislation (Legge 8 Novembre 2012, which transposed Decreto Legge 13 Settembre 2012, n. 158), selling alcohol to minors is prohibited. Therefore, the User declares to be of legal age according to the legislation applicable to them. The use of the Service is only permitted for Users of legal age according to Italian law (over 18 years old) and according to the legislation of the countries where the Users are located and which is applicable to them. Any use of the Service by underage Users presupposes and implies the authorization and supervision of parents or legal guardians, who will therefore assume full responsibility for the actions of the minor towards Scacco Malto S.r.l. and any third parties involved. The free consultation of the Products is provided. The use of the Service by Users only entails the payment of the established price indicated on the Product. The payment of the aforementioned price is made through PayPal. Users also agree not to misuse the contacts available in any capacity on the platform www.scaccomalto.online. This includes but is not limited to the prohibition of sending unauthorized or unsolicited advertising, promotional material, or any other form of solicitation via email or any other contact method.

5. USER RESPONSIBILITY

The User is entirely and exclusively responsible for the use of the Service (specifically referring to functions such as consultation, information requests, purchase of Products, and posting reviews). The User expressly acknowledges that Scacco Malto S.r.l. cannot be held responsible for any defamatory, offensive, or illegal conduct by other Users or third parties, and that the risk of any damages entirely falls under the User's personal responsibility. Scacco Malto S.r.l. does not guarantee that the Products do not infringe on any copyright, industrial property rights, or other rights of third parties. The User agrees to use the forms available on www.scaccomalto.online, .eu, .store, .net for their intended purposes using appropriate language, in compliance with the law, ethics, and netiquette. Furthermore, the User assumes all responsibility for any damages that may arise to their computer system from the use of the Service.

6. LIMITATION OF LIABILITY

Scacco Malto S.r.l., in the event that the delivered products do not correspond to what was published, reserves the right at any time to remove the publication of the Product/service at its sole discretion. The Service is offered through the websites www.scaccomalto.online, .eu, .store, .net, and mobile applications that may contain banners/links to other websites or applications not under the control of Scacco Malto S.r.l.. The publication of said banners/links does not imply approval or endorsement by Scacco Malto S.r.l. of the respective sites and their content, nor does it imply any form of warranty by the latter, thus disclaiming any responsibility. The User therefore acknowledges that Scacco Malto S.r.l. is not responsible, merely by way of example, for the truthfulness, accuracy, completeness, compliance with intellectual and/or industrial property rights, nor does it respond to their potential contravention of public order, decency, and/or morality.

7. LIMITATIONS IN SERVICE DELIVERY

Scacco Malto S.r.l. reserves the right to modify, suspend, or interrupt, in whole or in part, the Service at any time, even without prior notice. Similarly, Scacco Malto S.r.l. cannot be held responsible for damages resulting from the non-provision of the Service covered by this contract due to incorrect or failed operation of electronic communication means beyond the scope of its foreseeable control. For example, but not limited to, malfunctioning servers and other electronic devices not integral to the Internet network, malfunctioning installed software, computer viruses, as well as actions by hackers or other users with access to the network.

8. LIMITATIONS ON CONTENT OF PUBLICATIONS

The User undertakes not to falsify their identity and to comply with all current legal provisions as well as the rules of Scacco Malto S.r.l., which the User acknowledges and agrees to review before registering on the portal or contacting another User. Furthermore, the User agrees not to use the Service for the publication, transmission, exchange of illegal, vulgar, obscene, defamatory, offensive to prevailing morals, or otherwise injurious material or messages inciting hate and racial or religious discrimination. Additionally, the User agrees not to use the Service in a manner that violates the intellectual or industrial property rights of Scacco Malto S.r.l. or third parties.

9. JURISDICTION, APPLICABLE LAW, AND COMPETENT COURT

The relationships between Scacco Malto S.r.l. and Users are governed by Italian law and jurisdiction, based on which these General Terms shall also be interpreted. Except for mandatory legal provisions, the Court of Teramo shall have exclusive jurisdiction to settle any dispute concerning these General Terms and the relationships regulated by them.

10. VALIDITY OF THE GENERAL TERMS

These General Terms of Service shall be considered applicable, where compatible, even in the event of further, different, and specific agreements related to paid services. Scacco Malto S.r.l. may, however, unilaterally make changes to these General Terms at any time by providing notice on its web platform.
